Abstract

ABSTRACT

This research contains a review of hadith number 1533 from the book al-Mustadrak ‘alashohihain by al-Hakim. This research focuses on takhrij hadith and discusses the meaning of matan and its fiqh content, namely regarding the fiqh of a wife's donation of her property. This research uses a descriptive-qualitative approach, as the researcher attempts to traces the chain of ruwat of the hadith and then examine its authenticity and reliability in order to conclude the ruling of the hadith. As for the meaning of the text of the hadith and its fiqh, the researcher refers to the books of hadith commentary and the explanations of the fuqaha'. The results of the research show that there is a difference of opinion regarding the center of chain of the hadith, which originates from a narrator named Bukair, and the most valid chain of narration is the one narrated by Bukhari and Muslim in the two sahih collections, this making the hadith sahih. From a fiqh perspective, the hadith indicates that it is permissible for a wife to donate her own wealth without her husband's permission.
